2. Services Description

Cape Nova Capital provides a lead-capture and manual matching service designed to connect:

Property sellers who hold equity in their property but require a transaction outside the standard bank-financed route; and
Property buyers who have a cash deposit available but cannot obtain a conventional mortgage bond.

Cape Nova Capital facilitates the introduction and deal structuring process. We do not act as a bank, a mortgage originator, a registered estate agent, a financial services provider, or a registered credit provider under the National Credit Act.

All deals are independently structured, and parties are encouraged to obtain independent legal advice before entering into any agreement.

3. No Guarantee of Match

Submitting an application does not guarantee that a suitable match will be found. Cape Nova Capital makes no warranty, express or implied, that:

A match exists or will be found for your application;
A deal structure proposed will be accepted by all parties;
Any proposed deal will be successfully completed.

Matching is performed manually by our team. We will communicate the status of your application within the timeframes stated on the Site, but we cannot guarantee outcomes.

4. Not Financial or Legal Advice

Nothing on this Site or in any communication from Cape Nova Capital constitutes financial, legal, tax, or investment advice. All information provided is for general informational purposes only.

We strongly recommend that all parties involved in any deal structure:

Obtain independent legal advice from a qualified attorney or conveyancer

Providing materially false or misleading information may result in your application being rejected and may expose you to legal liability.

All content on this Site — including but not limited to text, design, graphics, logos, and structure — is the intellectual property of Cape Nova Capital (Pty) Ltd and may not be reproduced, distributed, or used without prior written permission.

7. Limitation of Liability

To the maximum extent permitted by applicable South African law, Cape Nova Capital shall not be liable for:

Any indirect, special, incidental, or consequential damages arising from use of this Site or our services;
Loss of data, revenue, or opportunity resulting from an unsuccessful match or deal;
Actions taken by matched parties independently of Cape Nova Capital;
Technical errors, downtime, or unavailability of this Site.

Our total liability for any claim shall not exceed the amount paid by you to Cape Nova Capital in connection with the subject matter of the claim.

8. Governing Law

These Terms of Use are governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising from these terms or your use of this Site shall be subject to the jurisdiction of the South African courts.
